Asking for Help

July 30, 2009 by

New York’s Attorney General is taking responsibility for suing to vacate thousands of default judgments. But this legal action is only targeting judgments that were wrongfully obtained as a result of one particular process server’s massive fraudulent behavior. But what can the individual consumer do after they’ve had a default judgment wrongfully entered against them, when it doesn’t involve this particular process server? Today, I’ll talk about the way for individual...

100,000 Judgments Against Consumers are Challenged

July 28, 2009 by

NY Attorney General Andrew Cuomo is suing a process server to vacate more than 100,000 default judgments entered against consumers based on defective service of process. In my ebook “What to Do When Creditors Sue! I talk about how someone might have gotten a judgment against you without you knowing about it until they either freeze your bank account, or try to garnish your wages by using what is commonly referred to as “sewer service.” The process server swears that a person was...

A Cash-Based Economy

July 28, 2009 by

There’s a new credit-card bill of rights now, and I intend to summarize it for you soon. Meanwhile, my own credit-card bill of rights involves one simple act: cutting up my credit cards. That’s right! I haven’t used a credit card in more than 5 years! Impossible, you say? How can you rent a car? Go on vacation? What about an emergency? What would you do if you had an emergency while away? I’m here to report that I’ve rented cars with my logo debit card, paid cash...

The 20-day Rule

July 27, 2009 by

Do you know about the 20-day rule? If you get sued in New York for just about anything, you have 20 days from the day you receive the legal papers to file an “answer” to those papers. That includes Saturdays, Sundays, and holidays. Unless the 20th day falls on a Saturday, Sunday, or holiday, then you have till the next business day. But I wouldn’t wait for that next business day. I wouldn’t wait for the 20th day under any circumstances. Because if you miss this “filing”...

Marcy's Theory of Relativity

July 24, 2009 by

People are terrified of going to court. That might be one of the basic principles of energy, up there with Einstein’s theory of relativity. No one wants to go to a government agency’s office, let alone appear before a judge, even if their story is rock solid and totally innocent. Where does all this fear come from? I mean this is a democracy, right? No one is going to lock you up on unstated charges at the Parking Violations Bureau just for showing up to pay a long overdue ticket, right? But...

Getting Organized

July 23, 2009 by

Yesterday, I talked about how the simplest steps can lead you to live life as a responsible borrower. Especially for those who are struggling with damaged credit and unpaid bills, the smallest measures to regaining financial stability can have a huge impact. Today, I want to talk about getting organized, as one of those small steps. I’m always thinking about people who have been sued by their credit card company or bank, and what an enormous amount of personal chaos this type of lawsuit...

The First Step

July 22, 2009 by

If you’ve been sued by a credit card company, you are probably totally freaking out, or you are so under water with your other financial issues, that you can’t even be concerned about the creditor who just happens to be suing you today. What I’ve learned from personal experience is that if your financial life is a mess it’s not going to be fixed with one big fix. It’s not about your ship coming in, your rich aunt dying and leaving you a fortune, or the bank refinancing...
